How do I know if my issue is an emergency?

An emergency is a problem that needs immediate action to prevent serious damage to the building or immediate risk to health and safety. Emergencies usually can’t wait until normal office hours without making the situation worse.

If there is danger to people, property, or the structure of the building, it is likely to be an emergency.

What are examples of an emergency repair?

Typical emergencies include:

  • Severe water leaks or burst pipes affecting common areas

  • Flooding that cannot be contained
  • Fire damage or immediate fire risk in common parts
  • Dangerous structural issues (e.g. loose masonry, collapsing walls)
  • Total loss of essential services to the whole building (such as power or water)
  • Storm damage making the building unsafe

Your Written Statement confirms that emergency repairs are those needed to “prevent serious damage to the building or immediate danger to health and safety” Written Statement of Services.

What is not considered an emergency?

These issues are usually not emergencies and should be reported during normal office hours:

• Dripping taps or minor leaks that can be contained
• Faulty door entry systems
• Individual heating or boiler problems within your own property
• Blocked sinks or toilets inside your home
• General wear and tear

While inconvenient, these do not usually pose immediate risk to the building or others.

What happens if I call out a contractor out of hours?

Out-of-hours call-outs are significantly more expensive. If a contractor attends and the issue is not deemed an emergency, the cost may still be payable.

If the issue relates only to your own property and not the common parts, you may be personally responsible for the full cost of the call-out, as set out in section 7.5 of your Written Statement Written Statement of Services.

Who decides if something is an emergency?

Under your Written Statement, the Factor has sole discretion to determine whether a repair is treated as an emergency, based on the conditions and hazards present at the time Written Statement of Services.

This is consistent with the Property Factors (Scotland) Act 2011, which allows factors to act promptly where delay would cause harm.

What should I do before calling out of hours?

Ask yourself:

  • Is anyone in immediate danger?
  • Is the building at risk of serious damage right now?
  • Can the issue safely wait until the next working day?

If the answer is “yes, it’s dangerous or could cause serious damage”, please call the emergency number.

If not, report it during office hours so it can be handled efficiently and cost-effectively.

What will the Factor do in an emergency?

Where an emergency repair is required, the Factor will instruct an approved contractor to make the situation safe. Homeowners will be advised of costs once known, and charges will be apportioned in line with the Title Deeds
